This policy governs the use of email and other IT systems by alumni at Bastyr University.
By using the email account, each user agrees to be bound by all of the Conditions of Use set forth in the following paragraphs. Bastyr University reserves the right in its sole discretion to deny access to any user.
Use that impedes, interferes with, impairs, or otherwise causes harm to the activities of others. Users must not deny or interfere with or attempt to deny or interfere with service to other users in any way, including by "resource hogging," misusing mailing lists, propagating "chain letters" or virus hoaxes, "spamming" (spreading email or postings widely and without good purpose), or "bombing" (flooding an individual, group, or system with numerous or large email messages). Knowing or reckless distribution of unwanted mail or other unwanted messages is prohibited. Sending email to someone who has requested that you not do so is prohibited. Other behavior that may cause excessive network traffic or computing load is also prohibited.
Reproduction of Information. No User may reproduce, or otherwise utilize, for commercial purposes the information provided by Bastyr University through the Service without the written permission of Bastyr University. Consequently, without such written permission, no User may resell or commercially exploit the names, addresses or other data obtained by use of the service.
Sharing of accounts. Do not give your password and login name to other people or allow them to access your account.
Misrepresentation of Bastyr University. Email users shall not give the impression that they are speaking for, making statements on behalf of, or otherwise representing Bastyr University unless they are explicitly authorized to do so.
Use that is inconsistent with Bastyr University's non-profit status. The University is a non-profit, tax-exempt organization and, as such, is subject to specific federal, state, and local laws regarding sources of income, political activities, use of property, and similar matters. As a result, commercial use of email for non-Bastyr University purposes is generally prohibited, except if specifically authorized and permitted under University conflict-of-interest, outside employment, and other related policies. Prohibited commercial use does not include communications and exchange of data that furthers the University's educational, administrative, research, clinical, and other roles, regardless of whether it has an incidental financial or other benefit to an external organization.
Bastyr University addresses may not be utilized as return addresses for commercial email solicitations, advertising, offensive or illegal communications, communications which infringe intellectual property rights, or communications which harass, intimidate or otherwise violate the rights of others. Bastyr University reserves the right to terminate the registration of any person who violates this policy.
Use of email in a way that suggests University endorsement of any political candidate or ballot initiative is also prohibited.
Harassing or threatening use. This category includes, but is not limited to the display of offensive, sexual material in the workplace and repeated unwelcome contacts with another.
Use damaging the integrity of University email or other IT Systems. This category includes, but is not limited to, the following four activities:
Attempts to defeat system security. Users must not defeat or attempt to defeat any IT system's security -- for example, by "cracking" or guessing and applying the identification or password of another User, or compromising room locks or alarm systems. (This provision does not prohibit, however, Systems Administrators from using security scan programs within the scope of their Systems Authority.)
Unauthorized access or use. The University recognizes the importance of preserving the privacy of Users and data stored in IT systems. Users must honor this principle by neither seeking to obtain unauthorized access to IT systems, nor permitting or assisting any others in doing the same. Users are prohibited from accessing or attempting to access data on IT systems that they are not authorized to access. Furthermore, Users must not make or attempt to make any deliberate, unauthorized changes to data on an IT system. Users must not intercept or attempt to intercept or access data communications not intended for that user, for example, by "promiscuous" network monitoring, running network sniffers, or otherwise tapping phone or network lines.
Disguised use. Users must not conceal their identity when using IT systems. Users are prohibited from masquerading as or impersonating others or otherwise using a false identity. Users are prohibited from obscuring the true identity of the sender of an email or forging email messages.
Distributing computer viruses. Users must not knowingly distribute or launch computer viruses, worms, or other rogue programs.
Use in violation of law. Illegal use of IT systems -- that is, use in violation of civil or criminal law at the federal, state, or local levels -- is prohibited. Examples of such uses are: promoting a pyramid scheme; distributing illegal obscenity; receiving, transmitting, or possessing child pornography; infringing copyrights; making bomb threats; intercepting electronic communications without proper authority; and making unlicensed copies of copyrighted works.
With respect to copyright infringement, Users should be aware that copyright law governs (among other activities) the copying, display, and use of software and other works in digital form (text, sound, images, and other multimedia). The law permits use of copyrighted material without authorization from the copyright holder for some educational purposes (protecting certain classroom practices and "fair use," for example), but an educational purpose does not automatically mean that the use is permitted without authorization.
Use in violation of University contracts. All use of IT systems must be consistent with the University's contractual obligations, including limitations defined in software and other licensing agreements.
Use in violation of University policy. Use in violation of other University policies also violates this AUP. Relevant University policies include, but are not limited to, those regarding sexual harassment and racial and ethnic harassment.
Use in violation of external data network policies. Users must observe all applicable policies of external data networks when using such networks.
Bastyr University may modify these Conditions of Use at any time by publication through the email system.
EACH USER EXPRESSLY AGREES THAT USE OF THE SERVICE IS AT THE USER'S SOLE RISK. BASTYR UNIVERSITY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE; NOR DOES BASTYR UNIVERSITY MAKE ANY WARRANTY AS TO THE RESULTS TO BE OBTAINED FROM USE OF THE SERVICE. THE SERVICE IS DISTRIBUTED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR OTHERWISE, OTHER THAN THOSE WARRANTIES WHICH ARE IMPLIED BY AND INCAPABLE OF EXCLUSION, RESTRICTION, OR MODIFICATION UNDER THE LAWS APPLICABLE TO THIS SERVICE. NEITHER BASTYR UNIVERSITY NOR ANY ONE ELSE INVOLVED IN CREATING, PRODUCING, OR DELIVERING THE SERVICE SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF USE OF THE SERVICE OR INABILITY TO USE THE SERVICE OR OUT OF ANY BREACH OF ANY WARRANTY.
